1. Agreement that KITAMILA Pty Ltd may seek consumer credit information (section 18K(1)(b), Privacy Act 1988). If KITAMILA Pty Ltd considers it relevant to assessing my/our application for commercial credit, I/we agree to KITAMILA Pty Ltd obtaining from a credit reporting agency a credit report containing personal credit information about me/us in relation to commercial credit provided by KITAMILA Pty Ltd.

2. Exchanging information with other credit providers (Section 18N(1 (b), Privacy Act 1988) I/we agree to KITAMILA Pty Ltd obtaining personal information about me/us from other credit providers, whose names I/we may have provided for KITAMILA Pty Ltd or that may be named in a credit report, for the purpose of assessing my/our application for commercial credit made to KITAMILA Pty Ltd.

3. I/we agree to any credit provider being given a consumer credit report to collect overdue payments on commercial credit (Section 18K(1)(h) Privacy Act 1988)

4. I/we agree that KITAMILA Pty Ltd may obtain a consumer credit report about me/us from a credit reporting agency for the purpose of collecting overdue payments relating to commercial credit owed by me/us.

5. Retention of Title. Risk in any goods supplied by KITAMILA Pty Ltd to the customer shall pass when good are delivered to the customer or into custody on the customer’s behalf, but ownership in such goods shall be retained by KITAMILA Pty Ltd until payment is made for the goods. Until such payment has been made in full, the customer shall hold the goods as Bailee only for KITAMILA Pty Ltd. Should any goods sold become constituents of or be converted into other products while subject to KITAMILA Pty Ltd, ownership shall extend to those other products. If the customer defaults on the payment, or enters bankruptcy, liquidation or has a receiver appointed, it shall be lawful for KITAMILA Pty Ltd, without notice, to enter the customer’s premises where the goods may be and take possession of them. If the customer re-sells the goods before legal ownership has passed, then the customer shall be deemed to be acting as KITAMILA Pty Ltd agent and shall therefore keep the proceeds separate from any other monies and account to KITAMILA Pty Ltd.

6. I/we understand that credit terms of this agreement shall only be offered whilst trading terms are adhered to. Breach of the agreed terms shall result your credit facility being terminated, and account trading terms shall revert to a pre-paid basis only for purchases. Defaults on payment terms shall be recorded with credit reporting entities.

7. The debtor shall pay any collection costs including but not limited to legal expenses and debt collection commissions incurred in obtaining payment for any goods supplied by KITAMILA Pty Ltd.

8. “The Customer, and where the Customer is a Company each of its directors, charge all real and personal property, including both presently owned property and future acquired property with the payment of all monies owing to KITAMILA Pty Ltd.”

9. General Terms and Conditions of Trade: All goods must be paid in full by electronic funds, bank cheque, or cash transfer to our account before goods are dispatched.

10. New customers and shop owners with no previous trade history or references. Initial orders may require payment on a pre-paid basis. Trading terms or accounts may be negotiated after a period of trading, depending on trading volume and payment history. For those offered trading terms, goods will only be dispatched after the credit application has been processed in full and approved. This can take several working days.

Should an account be granted, the customer will be informed in writing. All orders in the interim period will be supplied on a PROFORMA basis only. Existing accounts will only remain in force if the “retention of title” section 5 and “Personal Guarantee” have been completed in full. Settlement terms of accounts are by individual written notice and agreement between the account and KITAMILA Pty Ltd. All goods remain the property of KITAMILA Pty Ltd as per section 5, until paid in full. The customer agrees to also pay the costs and expenses incurred in respect of any enforcement or recovery of either the monies owing by the customer or repossession of the goods. Discounts may not apply, and the supply of goods may be suspended if these terms are not adhered to.
KITAMILA Pty Ltd will carry out regular reviews of the credit limits and discount rates and the customer will be advised accordingly in writing. KITAMILA PTY LTD RESERVES THE RIGHT TO VARY ITS CREDIT TERMS FOR ANY CUSTOMER AT ITS DISCRETION.

A minimum of $200 per order + freight needs to be reached to qualify for wholesale pricing supplied by KITAMILA Pty Ltd. Orders must be placed via our online wholesale ordering portal or via email where this is not possible. Hours for customer pick up are 8.00am-12.30pm and 1.30pm-3.30 pm only.
